Terms and Conditions

These Terms and Conditions govern purchases, bookings, and use of the KBien Creations website (the “Website”). By placing an order, submitting payment, or booking a service, you agree to these Terms and Conditions.

1. Products and Services

KBien Creations offers curated gifts, custom gift boxes, bouquets, charcuterie products, party favors, event styling, and related services. Because many products are handmade, customized, seasonal, or perishable, the final product may vary slightly from photographs or samples shown online. We may make reasonable substitutions of equal or greater value when an item, flower, packaging material, or ingredient is unavailable. We will preserve the overall style, color palette, and value of the order whenever reasonably possible.

2. Orders and Acceptance

Submitting an order does not guarantee acceptance. An order is confirmed only after KBien Creations accepts it and receives the required payment or deposit. We may decline or cancel an order because of availability, delivery limitations, pricing errors, safety concerns, suspected fraud, or an inability to fulfill the request. If we cancel an order after payment, we will refund the amount paid for the canceled portion.

Customers are responsible for providing accurate contact, personalization, allergy, pickup, and delivery information. KBien Creations is not responsible for errors caused by incorrect or incomplete information supplied by the customer.

3. Pricing and Payment

Prices are listed in U.S. dollars and may change without notice. Applicable sales tax, delivery charges, rush fees, setup fees, and other approved charges will be added when required. Full payment is required for standard product orders unless otherwise stated.

Custom, bulk, wedding, corporate, realtor, or event orders may require a nonrefundable retainer or deposit. The remaining balance and due date will appear in the customer’s proposal, invoice, or service agreement. Work may be paused or the booking may be released if payment is not received by the stated deadline.

4. Custom Orders and Approvals

Customers must review names, dates, spelling, colors, quantities, dietary requests, and other custom details before approving an order. Approval may be given electronically. Once materials have been purchased or production has begun, changes may be unavailable or may require an additional fee. KBien Creations is not responsible for customer-approved errors.

5. Food Products, Allergies, and Safety

Charcuterie and other food products may contain or come into contact with common allergens, including milk, wheat, soy, eggs, peanuts, tree nuts, sesame, and other ingredients. Although we will consider allergy and dietary requests, KBien Creations cannot guarantee an allergen-free environment or prevent cross-contact. Customers and recipients are responsible for determining whether a product is suitable for them.

Perishable products should be refrigerated promptly and consumed within the timeframe provided with the order. Customers assume responsibility for proper handling and storage after pickup or delivery. Do not consume any item that has been left at an unsafe temperature, appears spoiled, or has damaged packaging.

6. Flowers and Natural Products

Flower varieties, shades, sizes, and shapes naturally vary. Seasonal substitutions may be made while maintaining the requested style and approximate value. Some flowers and greenery may be harmful if eaten and may be toxic to pets. Customers are responsible for keeping floral products away from children and animals and for following any care instructions provided.

7. Pickup and Delivery

Pickup and delivery times are estimates unless KBien Creations confirms a specific time in writing. The customer must provide a complete address, delivery instructions, recipient name, and working phone number. The recipient or an authorized person must be available when required.

If delivery cannot be completed because of an incorrect address, restricted access, an unavailable recipient, unsafe conditions, or another circumstance outside our control, the customer may be charged a redelivery fee. Once an order has been delivered according to the provided instructions or collected at pickup, responsibility for loss, theft, damage, temperature control, and storage transfers to the customer or recipient.

8. Event Services

Event styling, setup, rentals, and other event services may be governed by a separate proposal or service agreement. If that agreement conflicts with these website terms, the signed service agreement controls. The customer is responsible for venue access, permissions, accurate guest counts, and a safe working environment. Additional labor, scope changes, waiting time, parking, tolls, venue requirements, or damage to rental items may result in additional charges when disclosed and agreed upon.

9. Cancellations, Returns, and Refunds

All cancellations, returns, replacements, credits, and refunds are governed by the Refund and Cancellation Policy below, which is incorporated into these Terms and Conditions.

10. Photos and Intellectual Property

All Website content—including photographs, designs, text, graphics, logos, and product concepts—is owned by or licensed to KBien Creations and may not be copied, republished, sold, or used commercially without written permission.

KBien Creations may photograph completed products and event details for its portfolio, Website, and social media unless the customer requests privacy in writing before fulfillment. We will not intentionally publish private customer information. Photos clearly identifying people or private events will be used only with appropriate permission.

11. Website Use

You may not misuse the Website, interfere with its operation, attempt unauthorized access, submit fraudulent information, or use its content unlawfully. Links to third-party websites are provided for convenience; KBien Creations does not control and is not responsible for third-party content, policies, or services.

12. Disclaimer and Limitation of Liability

To the fullest extent permitted by law, KBien Creations is not liable for indirect, incidental, special, or consequential losses arising from an order, service, delivery delay, event, Website use, or a circumstance beyond our reasonable control. Our total liability for a claim will not exceed the amount the customer paid to KBien Creations for the product or service giving rise to that claim. Nothing in these Terms excludes rights or remedies that cannot legally be waived.

13. Events Beyond Our Control

KBien Creations is not responsible for delay or nonperformance caused by severe weather, natural disaster, illness, government action, transportation disruption, supply shortage, venue restriction, utility or internet outage, or another event beyond our reasonable control. We will communicate with the customer and offer a reasonable solution when possible.

14. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be handled in a court with jurisdiction in King County, Washington, unless applicable law requires otherwise.

Privacy Policy

KBien Creations respects your privacy. This Privacy Policy explains what information we collect, why we collect it, how we use and share it, and the choices available to you when you visit our Website, contact us, or place an order.

We may collect:

• Contact information, such as your name, email address, phone number, billing address, delivery address, and recipient information.

• Order information, such as products, personalization details, gift messages, event details, preferences, allergies or dietary requests you choose to provide, and order history.

• Payment and transaction information. Payments may be processed by Hostinger or another payment provider; KBien Creations generally does not receive or store complete payment-card numbers.

• Communications, including inquiries, reviews, survey responses, emails, and social-media messages.

• Website and device information, such as IP address, browser type, device type, pages viewed, referring pages, approximate location, and cookie or analytics data.

Please do not provide sensitive information that is unnecessary for your order. If you provide another person’s information for delivery or gifting, you confirm that you are authorized to provide it for that purpose.

We may also disclose information when required by law, to protect rights and safety, or to investigate fraud or misuse. KBien Creations does not sell personal information for money. If our practices change, this Policy will be updated and any legally required choices will be provided.

We retain personal information only as long as reasonably necessary to fulfill orders, maintain records, resolve disputes, enforce agreements, and comply with legal obligations. We use reasonable administrative, technical, and physical safeguards, but no online system or transmission is completely secure.

You may request access to, correction of, or deletion of personal information maintained directly by KBien Creations, subject to identity verification and legal recordkeeping requirements. You may also unsubscribe from marketing emails using the link in the message or by contacting us. Refund and Cancellation Policy

Because KBien Creations products are often handmade, customized, perishable, or created for a specific date, most sales are final. Please review all order information carefully before submitting payment.

1. Nonreturnable and Nonrefundable Items

Except when KBien Creations makes an error or a product arrives damaged or materially defective, we do not accept returns or issue refunds for:

• Charcuterie, flowers, food, and other perishable products.

• Custom, personalized, made-to-order, special-order, or themed items.

• Gift boxes or baskets assembled for a specific customer or recipient.

• Products that have been opened, used, altered, improperly stored, or damaged after pickup or delivery.

• Delivery charges, rush fees, setup fees, completed labor, or materials already purchased.

• Gift cards, except where required by law.

Differences caused by seasonal availability, natural flower variation, or a reasonable substitution of equal or greater value are not considered defects.

2. Damaged, Incorrect, or Missing Items

If your order is damaged, incorrect, incomplete, or materially different from what KBien Creations confirmed, contact us within 24 hours of pickup or delivery at Kbiencreations@gmail.com. Include your name, order number, a description of the issue, and clear photographs of the product and packaging. For food and floral items, keep the product available and stored appropriately while we review the claim.

If KBien Creations confirms an error, we may offer, as appropriate, a replacement, correction, store credit, partial refund, or full refund for the affected item. The available remedy depends on the issue, timing, product, and availability. This policy does not limit any rights provided by applicable law.

3. Customer Cancellations for Product Orders

• More than 72 hours before the scheduled pickup or delivery: contact us promptly. A refund may be issued less any nonrefundable payment-processing fees, completed design work, custom materials, special-order items, or ingredients already purchased.

• Within 72 hours of pickup or delivery: payments are nonrefundable, but KBien Creations may offer a date change or store credit at its discretion if production has not begun and materials can be reused.

• After production begins or materials are purchased: the order is nonrefundable.

Rush orders are nonrefundable once accepted.

4. Event, Wedding, Corporate, and Bulk Orders

Retainers or deposits for event styling, weddings, corporate gifting, realtor gifting, favors, and bulk orders are nonrefundable because they reserve capacity and may cover planning, sourcing, and purchased materials. Cancellation schedules, final-payment deadlines, rescheduling terms, and any additional cancellation charges will be stated in the proposal or service agreement. If no separate agreement applies, payments become nonrefundable once planning, sourcing, purchasing, or production begins.

5. Rescheduling

Requests to change a fulfillment or event date are subject to availability. Previously purchased perishable items, custom materials, increased supplier costs, and additional labor may be charged to the customer. Approval of one date change does not guarantee future changes.

6. Pickup and Delivery Issues

Orders not collected at the agreed pickup time are not eligible for a refund. Perishable items may be discarded when they can no longer be safely or reasonably stored. Failed delivery caused by incorrect information, unavailable recipients, access restrictions, unsafe conditions, or customer-requested changes is nonrefundable, and redelivery may require an additional fee.

7. KBien Creations Cancellations

If KBien Creations cannot fulfill an order and no acceptable replacement or rescheduled date is agreed upon, we will refund the amount paid for the unfulfilled product or service. We are not responsible for additional purchases or losses beyond the amount paid to KBien Creations, except where applicable law requires otherwise.

8. Refund Timing

Approved refunds are returned to the original payment method when possible. Processing times vary by bank or payment provider and may take approximately 5–10 business days after the refund is issued.
